The Association of Inspectors General is proud to present the New York/New Jersey Chapter Training, Government Workplace Search and Seizure on Wednesday, December 3, 2025, from 10:00 am - 12:00 pm (Eastern Time) / 9:00 am - 11:00 am (Central Time) / 7:00 am - 9:00 am (Pacific Time). This virtual training will be held via Webex.

Session Overview

This high-energy webinar will equip government investigators and supervisory officials with a comprehensive understanding of how Fourth Amendment and New York State constitutional protections apply in public-sector workplaces. Attendees will learn when searches by government employers are lawful, what limitations apply, and how to balance operational needs with employee privacy rights. This training will give public employers confidence when they perform inspections, audits, and investigations while respecting constitutional privacy standards. Through case examples and practical policy recommendations, participants will gain the tools to ensure legally defensible workplace searches in government settings.

Learning Objectives

By the end of this session, participants will be able to:

1. Identify the legal standards governing searches conducted by government employers under the Fourth Amendment and Article I, § 12 of the New York Constitution.

2. Differentiate between workplace areas where employees have a reasonable expectation of privacy (e.g., desks, lockers, computers) and areas where they do not.

3. Explain when a government agency may conduct work-related or misconduct-related searches without a warrant, consistent with the “reasonableness” standard recognized by New York courts.

4. Assess when employer notice, consent forms, or policy statements effectively reduce an employee’s expectation of privacy in the workplace.

5. Recognize the evidentiary and civil consequences of unlawful searches, including suppression of evidence and potential §1983 liability.

6. Apply best practices for drafting and implementing lawful workplace search policies to minimize constitutional risks.
